TERMS AND CONDITIONS OF USE — PERLA CIS AND CARTERO 1. Purpose Perla CIS is a platform that collects mail from the accounts the user connects and delivers it to BlackBerry OS 5 devices through the Cartero application, after the shutdown of the original BIS/BES services. These terms govern the use of the portal, the server and the application, provided by Hostinext OÜ. 2. Acceptance Using the portal or installing the application implies full acceptance of these terms and of the Privacy Policy. If you do not agree, do not use the service. 3. Account and devices The user is responsible for keeping their portal password, activation codes and devices safe. Each device is activated with a one-time code and receives its own key; the user must remove from the portal any device that is lost or handed over. Perla CIS is currently a private instance with closed registration. 4. Connected mail accounts The user declares to own, or to be authorised to use, the mail accounts they connect, and accepts the conditions of their providers (Google, Microsoft or others). App passwords or OAuth tokens are used on the user's behalf and under their responsibility. 5. Permitted and prohibited use Personal, reasonable use of the service is permitted. It is forbidden to: use it to send unsolicited bulk mail, fraud, impersonation or any unlawful content; attempt to access other users' accounts, devices or data; overload, attack or interfere with the server or the portal; decompile, modify or redistribute the application or the protocol; connect the application to unauthorised servers; and any use contrary to the law or to these terms. Breach entitles Hostinext OÜ to suspend or cancel the account. 6. Technical limits and availability The service is provided as is, on devices more than ten years old and over networks being phased out. Continuous availability, a given latency or compatibility with future versions of the mail providers are not guaranteed. The service collects only the folders the user chooses and, outside the inbox, skips messages larger than 1 MB. The device displays mail in a reduced format and does not reproduce all original content (images, attachments, active links). 7. Intellectual property The Cartero application, the server, the portal, their trademarks, icons, texts and the protocol are the property of Hostinext OÜ. BlackBerry is a trademark of BlackBerry Limited, unrelated to this service. 8. Liability To the extent permitted by law, Hostinext OÜ is not liable for lost mail, delays, unauthorised access resulting from the user's negligent custody of credentials, or indirect damages. Total liability is limited to the amount paid by the user for the service in the preceding twelve months, if any. 9. Termination The user may stop using the service at any time by removing their accounts and devices or requesting deletion of their account. Hostinext OÜ may suspend the service for breach, legal requirement or technical reasons, giving notice when reasonably possible. 10. Changes These terms may be updated; the current version is the one published in the portal and in the application. Substantial changes will be announced through the application's notice system. 11. Governing law These terms are governed by the laws of Estonia and the European Union. The courts of Tallinn shall have jurisdiction, without prejudice to the rights consumer law grants the user in their place of residence.
